Terms and Conditions

At Japanerimport we buy and sell used cars and also assist our customers in finding and importing vehicles from abroad.

We have many years of experience in importing cars. While our focus was previously primarily on specialist cars from Japan, we now work with a much broader range of vehicles, including everyday passenger cars, electric cars, specialist cars and vehicles sourced according to our customers’ individual requirements.

The following terms and conditions apply unless otherwise stated in the specific sales contract or purchase agreement.

Purchase of Cars in Stock

When purchasing a car owned and sold by Japanerimport, a sales contract will be prepared stating the vehicle’s price, mileage, registration details, known defects and faults, as well as any special agreements.

All our cars are used vehicles unless expressly stated otherwise. Normal wear and signs of use should therefore be expected in accordance with the vehicle’s age, mileage and price.

The buyer is encouraged to inspect and test-drive the vehicle before purchase.

Sales to Private Customers

When a private individual purchases a car directly from Japanerimportthe purchase is subject to the provisions of the Danish Sale of Goods Act relating to consumer purchases.

The buyer has a 2-year statutory right to make claims for defects under the Danish Sale of Goods Act. This right covers defects that were present at the time of delivery, or where the cause of the defect was present at the time of delivery.

When assessing whether a defect exists, consideration is given, among other things, to the vehicle’s age, mileage, price, general condition and the information provided about the vehicle prior to purchase.

Normal wear and tear, as well as faults and conditions that the buyer has been expressly informed about prior to purchase, will not necessarily constitute defects under the Danish Sale of Goods Act.

Japanerimport does not provide a separate warranty on the vehicle unless this has been specifically agreed in writing. This does not limit a private buyer’s statutory rights regarding defects.

Sales to Businesses / Company Registration Number

When a vehicle is sold to a company, business or other buyer purchasing the vehicle as part of commercial activities, the transaction is considered a business-to-business purchase.

Unless otherwise agreed in writing in the sales contract, the vehicle is sold in the condition in which it is at the time of delivery, including any defects, faults and wear that may exist.

For business purchases, the right to make claims for defects, warranty and the seller’s liability may be limited by agreement and will be stated in the specific sales contract.

Unless otherwise expressly agreed in writing, no separate warranty is provided for business purchases.

The sales contract will always state when a vehicle is sold as a business-to-business purchase.

Brokerage Sales – Vehicles Sold on Behalf of Customers

Japanerimport also offers to facilitate the sale of vehicles on behalf of private vehicle owners.

In a genuine brokerage sale, Japanerimportacts solely as an intermediary and is not the owner or seller of the vehicle.

Before purchase and in the sales contract, it will be clearly stated that the transaction is a brokerage sale, and the private owner/seller and buyer will be identified in the purchase agreement.

The transaction is therefore concluded directly between the vehicle’s owner and the buyer.

Any claims relating to the vehicle should, as a general rule, be directed towards the seller identified in the sales contract, in accordance with the rules and agreements applicable to the specific transaction.

Japanerimportdoes not provide an independent warranty on vehicles where we act solely as an intermediary.

Importing a Vehicle to Customer Specification

If you are looking for a specific vehicle that we do not have in stock, Japanerimport can assist in finding and importing the vehicle from abroad.

This may include vehicles from Germany, Japan or other relevant markets.

Before purchasing a vehicle, we will, to the extent possible, obtain information about its history, mileage, equipment and general condition, as well as photographs and other available documentation.

For vehicles imported to order, an individual purchase agreement will be prepared before the vehicle is purchased and imported. This will include, among other things, the vehicle’s price, payment terms, transport costs, Danish registration tax, estimated delivery time and any special conditions applicable to the specific transaction.

As used vehicles purchased abroad may have normal signs of use and minor cosmetic imperfections, these should be expected in accordance with the vehicle’s age, mileage and price.

Payment for Special-Order and Imported Vehicles

For vehicles purchased or imported specifically at the customer’s request, Japanerimport may require a deposit or full/partial payment in advance.

Payment terms will always be agreed in writing before the vehicle is ordered or purchased.

Once Japanerimport, following the customer’s approval, has entered into a binding agreement to purchase a specific vehicle abroad, the customer’s order cannot be cancelled without further consideration.

Any terms and costs relating to cancellation will be stated in the specific purchase agreement.

Registration Tax and Delivery

For imported vehicles, it will be agreed individually whether the quoted price includes or excludes Danish registration tax, number plates, vehicle inspection, transport and other costs.

This will always be stated in the quotation or sales contract.

We are happy to assist with the entire process relating to transport, vehicle inspection, customs inspection, registration tax and Danish registration when this is included in the agreement.

Information About the Vehicle

We make every effort to ensure that all information about vehicles on Japanerimport.dk and other sales platforms is correct.

We reserve the right to correct typing errors and errors in information originating from third parties, foreign sales advertisements, databases or previous owners, to the extent permitted by applicable law.

The vehicle’s final equipment, condition and any known defects or faults will be stated in the specific sales contract and in the inspection carried out in connection with the transaction.

Special and Modified Vehicles

When purchasing older specialist cars, classic cars, sports cars, tuned vehicles or modified vehicles, a different level of maintenance and wear should be expected compared with ordinary newer standard vehicles.

Any known modifications, tuning or special conditions relating to the vehicle will, to the extent possible, be disclosed prior to the transaction and noted in the sales contract when relevant to the purchase.

For sales to private customers, such information does not limit the buyer’s mandatory statutory rights under the Danish Sale of Goods Act.

Sales Contract

A sales contract or other written purchase agreement will be prepared for all vehicle transactions.

The specific sales contract contains the individual terms and conditions applicable to each transaction and, together with these general terms and conditions, is intended to describe the agreement between the buyer and seller.

In the event of any discrepancy between these general terms and conditions and an individually agreed written provision in the sales contract, the individual agreement shall prevail to the extent permitted by applicable law.
